General Rental Conditions
- Conclusion of contract
1.1 The Client submits a request to the Organizer, either by letter, electronic means or telephone, and receives the rental agreement. The signed rental agreement has to be returned within 2 weeks and becomes effective upon receipt by the Organizer.
1.2 In the case of on-site booking, the contract becomes effective when the Client pays the rental price and signs the rental agreement.
1.3 In the case of short-term rental, the agreement may also be conducted by oral statement or telephone. At the same time, the Client accepts the General Terms and Conditions and assumes liability for implementation of his contract with the Organizer.
- Payment
2.1 The rental price is due upon receipt of the bill.
2.2 In the case of short-term or on-site rental payment is due before the start of the tour.
- Services
The scope of the contractual agreement is defined by the offer of the Organizer.
- Age Provisions
Minors are allowed to ride a trolley only if attended by an adult. Parents are responsible for their children!
- Cancellation (Withdrawal by the Client)
5.1 The rental agreement may be cancelled by written notice only.
5.2 If cancellation is announced no later than 7 days before the tour half of the rental price may be credited for later booking. Deadline is determined by the date of receipt of the written notice of cancellation by Tourist Information Kusel.
5.3 Nonappearance without express notice of cancellation is not regarded as withdrawal from the rental agreement.
- Weather Conditions
The trolleys are available from March through October irrespective of the weather. In the case of poor weather, the Organizer (Fremdenverkehrzweckverband Landkreis Kusel) is not bound to offer an alternative program. The Organizer does not provide any means for protection against the sun or rain.
- Obligation to Cooperate
In case of the occurrence of trouble, the Client is obligated to help prevent or minimize possible damage in accordance with statutory requirements. Above all, he/ she is responsible to immediately inform the Organizer about his/ her complaints and/ or have his staff confirm the complaint on the contract. This is also true for damage he/ she identifies on the trolley and/ or the route.
- Warranty, Liability and Limitation
8.1 The Organizer assumes liability in accordance with the statutory warranty policy that the trolleys are free from defects. Liability without fault pursuant to §538 German Civil Code is, however, excluded in its entirety.
8.2 The Organizer does not assume liability for damaged or lost items.
8.3 The Organizer does not assume liability for services by third parties that have not satisfactorily been provided.
8.4 The Client has the duty of supervision of the rental object over the course of the rental period and is liable for damages and loss of complete trolleys or parts of trolleys. The Client is also liable for damages caused by third parties or accidents if the originator cannot be detected.
8.5 Claims by the Client from other than physical damages are limited to triple the amount of the tour cost if the damage to the Client is not due to a deliberate act or gross negligence or if the Organizer is only responsible for damage to the Client caused by a service provider.
8.6 Claims against Fremdenverkehrszweckverband Landkreis Kusel from poor provision of services become statute-barred after a 6-month-period, except claims from tortious acts which become statute-barred after3 years. Limitation starts on the date of the trolley tour.
